Seven heavily protected prison officers wearing helmets and carrying batons are shown entering Mr Spratt's prison cell and yelling at Mr Spratt to turn around and lie down. "If you don't lay down, I'm going to taser you. Turn around and lay down. That's it, I'm not going to ask you again. If I have to ask you again I'm going to taser you," one officers shouts. After an unarmed Mr Spratt apparently refuses, a prison officer tasers Mr Spratt twice and he is then pinned face down on the floor. The officers then demand Mr Spratt extend his arms straight out while an officer drives a Taser into the small of his bare back and uses it nine times. Under the United Nations Torture Convention of 1984, torture involves intentional infliction of pain, by a public official, to obtain information [...or other purposes as listed below]. The full definition of torture in the convention is:
"Any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity."
This definition excludes "pain or suffering arising only from, inherent in or incidental to lawful sanctions", which seems designed to permit the death penalty. [LINK]
