The primary purpose of this blog is to provide an outlet for my observations and analysis about tasers, taser "associated" deaths, and the behaviour exhibited by the management, employees and minions of Taser International. In general, everything is linked back to external sources, often via previous posts on the same topic, so that readers can fact-check to their heart's content. This blog was started in late-2007 when Canadians were enraged by the taser death of Robert Dziekanski and four others in a short three month period. The cocky attitude exhibited by the Taser International spokespuppet, and his preposterous proposal that Mr. Dziekanski coincidentally died of "excited delirium" at the time of his taser-death, led me to choose the blog name I did and provides my motivation. I have zero financial ties to this issue.

RCMP planning to make about 50 taser policy changes

OTTAWA (Jim Bronskill, CP, 15 Feb 2010) - The RCMP plans a sweeping overhaul of its taser policy following recommendations from inquiries prompted by the death of Polish immigrant Robert Dziekanski. An internal briefing note obtained by The Canadian Press says the Mounties' policy centre on use of force recommends four dozen specific changes on stun gun use. ... [via TNT]

Well, assuming that these are the sorts of changes that we're expecting, then that would be nice.


I hope that the changes are accompanied by an explicit acknowledgment that the previous taser policies, almost certainly traceable back to slick-talking stungun salesmen, were wrong / incorrect / unethical / lethal / evil / deadly / counterproductive / immoral / dangerous / illegal / criminal.

There has to be some blowback against those within the law enforcement community that were so damn stupid and naive. But also the stungun salesmen that orchestrated much of this mess; they need to be held to account.

The 2008 Taser related death of Ricardo Abrahams resulted in a settlement by the the California city of Woodland in the amount of $300,000.00. The parents are suing the mental health facility (Yolo CCC) and Taser International, in civil court, for what I assume is negligence and contributing to the wrongful death of their son.

In searching their official SEC Filings, it is interesting that Taser International does not use the "Legal Proceedings" portion of their official SEC Filings to list the cases filed against them, and their outcomes, but lists the cases in the more obscure "Notes To Financial Information" on their Quarterly 10-Q and Annual 10-K Reports.

From those "Notes" we know that the Abrams case is "Discovery Phase-trial scheduled Oct — 2010", yet appears to be ongoing, unless separate suits and trails are being conducted against the Yolo CCC facility and the stun gun manufacturer.

The November 2005 "Rosa Wrongful Death" case, should have started and be ongoing, since it was scheduled for a December 2009 trial, in the US District Court in California's Northern District.


The Oct-04 Glowczenski wrongful Taser death suit, is commencing this February in the Eastern District Court of NY. As far as I can determine, it is the next wrongful death case to go to, or already be at trial, before March of this year, when the "Butler" case will be heard.

It might be helpful to start a "Trial Date List", since these legal proceedings seem to take years to come to trial, and are now piling/lining up for 2010.


Various "Training Injury" cases are also scheduled for trial this year.

If it is true that "Justice delayed, is justice denied", the seeming snails pace of the wrongful death cases filed against Taser International, is inflicting more harm on its victims.

The December 2009 Rosa case was decided:

"United States District Court for the Northern District of California entered an order and judgment for TASER International in the arrest-related-death lawsuit entitled Rosa v. TASER International, et al. granting TASER International's motion for summary judgment."

Although a summary judgment was issued in the Rosa case, the attorney for both Rosa and Heston ~ John Burton ~ plans to file appeals in both the Heston case to seek greater monetary awards, and to challenge the Rosa summary judgment:

"“Does he point to anything that happened [between the two deaths] that changed anything?” asks Pasadena attorney John C. Burton, who represents both the Rosa and Heston families. “Doesn't he have to point to something to say that?”

The summary dismissal of the Rosa case averts a trial that had been scheduled for next month. Burton says he will appeal the decision, which he called a “travesty.”
